THE TOTAL LIABILITY OF RWCE AND/OR ITS DEALERS, ASSOCIATES, AGENTS, AND LICENSORS UNDER ANY PROVISION OF THESE TOU, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, SHALL BE LIMITED TO THE TOTAL DOLLAR AMOUNT PAID FOR THE INFORMATION OR PRODUCTS GIVING RISE TO THE LIABILITY.

Return Policy
Any Product that is returned for a refund must be in the original packaging, undamaged, and resalable.  All requests for refunds will be subject to a restocking fee and processing fee of twenty-five dollars ($25.00) or an amount deemed appropriate by RWCE depending on the actual price of the product.  You are responsible for the risk of loss, shipping, and handling fees for returning the Product. Some products marketed and sold by RWCE are nonrefundable. Refund requests after 30 days from the purchase date will not be processed. No exceptions will be made to this policy unless another time frame is specifically provided in the particular product marketing campaign.  If the Product return is subject to a money-back guarantee, then a full refund will be issued as long as the product is in the original condition without wear and tear or any other damage. Shipping and handling charges will not be refunded on any Product returns including those subject to the money-back guarantee.

Cancellations
Requests for cancellation of any monthly billing must be in writing and mailed to Retire With Carla Enterprises 1400 Salter Street New Westminster, BC V3M 6Z4 Canada unless otherwise specified.  You may decide to cancel at any time, but charges will not be prorated.  You must cancel before your billing date in order to avoid a charge for the following month.

Coaching Programs must be canceled via mail to the address listed above or by e-mail to Carla@RetireWithCarla.com. Coaching Programs may be canceled at any time; however, the coaching fees are nonrefundable.  If you are not actively participating in your Coaching Program, including but not limited to coaching sessions, then RWCE will offer you a thirty (30) day courtesy period to fully engage in your coaching. If you fail to reengage within this thirty (30) day period, then your Coaching Program will be deemed canceled. RWCE will not be responsible for cancellations sent via email, but are not received by RWCE.

Bank Check Policy
A twenty-five dollar ($25.00) fee will be charged if your check payment is returned to RWCE for any reason (i.e., insufficient funds, account closing, etc.).  RWCE assumes no responsibility for fees, charges, or any other penalty that may be imposed by your bank as a result of an unpaid check.

No Unlawful or Prohibited Use

As a condition of your use of the website(s), you warrant to RWCE that you will not use the website for any purpose that is unlawful or prohibited by the TOU. You may not use the RWCE website in any manner that could damage, disable, overburden, or impair the website or interfere with any other party's use and enjoyment of the website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the RWCE website.

Limitation On Use of Information

You agree to use content or information obtained from the RWCE website only for your own private use or the internal purposes of your home or business. Under no circumstances, will you cause or permit any portion of the content or information on the RWCE website to be published, printed, downloaded, transmitted, distributed, reengineered, or reproduced in any form for resale, republishing, posting on a website, redistribution, or viewing unless otherwise provided by RWCE.

Access Restriction

RWCE reserves the right to terminate your access to the Information, products, services RWCE websites, and all related services at any time without notice. These terms of use constitute an enforceable legal agreement that is governed by the laws of the State of Florida in the United States of America. You hereby consent to the exclusive jurisdiction and venue of courts in Palm Beach County, Florida to hear and resolve all disputes arising out of or relating to the use of the products, services, information, and/or RWCE websites. RWCE's performance of this agreement is subject to existing laws and legal processes, and nothing contained in this agreement is in derogation of RWCE's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the products, services, or information provided to or gathered by RWCE with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified via written documentation, this agreement constitutes the entire agreement between the user and RWCE with respect to the RWCE products, services, and information.
